1. Acceptance of Terms
By accessing https://www.tonemediastudio.com or engaging ToneMedia’s services, you agree to these Terms & Conditions (“Terms”). If you do not agree, please refrain from using the site or our services.
2. Our Services
ToneMedia provides luxury wedding-filmmaking services including pre-production planning, filming, editing, and delivery of cinematic wedding films (“Services”). Service scope, pricing, and deliverables are detailed in each client’s signed agreement.
3. Bookings & Payments
A signed contract and retainer are required to secure your event date. Remaining balances follow the payment schedule stated in your agreement. Unless otherwise specified, retainers are non-refundable once booked.
4. Client Responsibilities
Clients must provide accurate event details and reasonable cooperation during filming (access, timing, lighting, and permissions). ToneMedia is not responsible for missed footage due to restrictions or interference beyond our control.
5. Intellectual Property
All footage and edited films remain the copyright of ToneMedia. Clients receive a personal, non-exclusive license to view, download, and share the delivered films for personal use. Re-editing, resale, or commercial use requires prior written consent.
6. Portfolio Usage
ToneMedia may use selected images or video excerpts for its website, social media, and marketing materials. Clients may request in writing to restrict usage before or upon signing the contract.
7. Delivery & Revisions
Final films will be delivered within the timeline specified in your contract. A set number of revisions are included; additional edits may incur fees.
8. Limitation of Liability
ToneMedia’s total liability for any claim related to the Services is limited to the amount paid by the client for those services. We are not liable for consequential, incidental, or punitive damages.
9. Indemnification
Clients agree to indemnify and hold ToneMedia harmless from claims, damages, or expenses arising from their breach of these Terms or misuse of delivered materials.
10. Force Majeure
ToneMedia is not responsible for delays or failure to perform caused by events beyond reasonable control (e.g., acts of God, illness, equipment failure, or venue restrictions). In such cases, reasonable efforts will be made to reschedule or substitute services.
11. Governing Law
These Terms are governed by the laws of the State of New Jersey, USA. Any disputes will be resolved exclusively in the state or federal courts located in Morris County, New Jersey.
12. Changes to Terms
We may modify these Terms from time to time. Updates take effect immediately upon posting to the Site. Continued use constitutes acceptance of the revised Terms.
